'DeVos "not familiar" with affirmative action guidance her agency scrapped'Jeffrey Rosen, President Donald Trump’s nominee to be second-in-command at the Justice Department, declined on Wednesday to tell the Senate whether he thought the Supreme Court ruled correctly in Brown v. Board of Education.
The remark came during Rosen’s confirmation hearing before the Senate Judiciary Committee. Sen. Richard Blumenthal, a Connecticut Democrat, pressed Rosen on Brown v. Board of Education, the landmark ruling that found school segregation to be unconstitutional; and Roe v. Wade, the ruling that affirmed that abortion access is a constitutional right.
“Would you agree that Roe v. Wade was correctly decided?” Blumenthal asked.
“What I would agree with is that it’s the precedent of the Supreme Court for better than 40 years now and unless and until that changes, it’s the law,” he replied.
“Was Brown v. Board of Education correctly decided?” Blumenthal asked.
“Senator, I don’t think that it would be a productive exercise for me to go through the most–thousands of Supreme Court opinions and say which ones are right and which ones are wrong,” he said.
“These are pretty simple questions,” Blumenthal said. “They’re answerable by yes or no. Most lawyers, I suspect, would agree based on knowledge of the law that these two cases, pillars of our jurisprudence, were correctly decided by the United States Supreme Court.”
“I, um, I have views about lots of Supreme Court cases,” Rosen said, “but I’m not being nominated for this position to be the Solicitor General nor a judge and I think in this context the point I’m trying to make is that, whatever the law is, whether it’s a decision I would favor or disfavor, I see it as the role of the Department of Justice to uphold the law such as it is, unless Congress or the courts change it.”
Blumenthal then pressed him on whether it was decided correctly, and Rosen said he didn’t have anything more to say.
Education Secretary Betsy DeVos told a House panel Wednesday that she is "not familiar" with affirmative action guidance for schools that the Trump administration rescinded last summer, or with a major Supreme Court ruling on which portions of the guidance were based.
The administration in July rescinded several guidance documents issued by the Education and Justice departments under the Obama administration that called on school superintendents and colleges to consider race when trying to diversify their campuses.
They included 2011 guidelines issued by the Obama administration for public schools that detailed a number of ways that school districts can consider diversity without making decisions based on the race of individual students. The Obama guidance stressed that school districts must “use race-neutral approaches only if they are workable.” But when they’re not, “school districts may employ generalized race-based approaches.”
Under questioning on Wednesday from Rep. David Trone (D-Md.) about the move to scrap the guidance, however, DeVos that she is "not familiar with that particular document." The exchange came during DeVos' first appearance before the House education committee since Democrats took control of the chamber.

Trone told DeVos that the "rescission of that guidance has caused confusion and fear about the intent of the Trump administration."
"So I’d like to give you an opportunity to clarify," he said. "I want to be clear that no matter what your action is, federal law and Supreme Court precedent still stands."
DeVos responded that "It’s valuable for every student to be in a school setting that has great diversity. I think it’s valuable for every student."
"The goal should be to have diversity of every sort," DeVos said. "The Supreme Court has opined in this and has given very clear guidance."
Earlier in the exchange, Trone asked DeVos whether she believes racial segregation "poses a threat to the educational opportunities for children of color," to which DeVos responded that "I’m concerned about every student, no matter where they are and where they go to school ..."
Trone pressed her again, saying "that’s an easy one, give me a yes on that one."
"I am concerned with every student," DeVos responded.

Science, according to a Trump appointee at the Department of the Interior, is "a Democrat thing." Those words were reportedly used to justify the abrupt 2017 cancellation of a study into the health effects of mountaintop removal for coal-mining. At the time, then-Interior Secretary Ryan Zinke claimed that the study was canceled after a careful review of the grant process.
But during a Tuesday congressional hearing on this issue, Rep. Alan Lowenthal, D-Calif., citing the inspector general's report into the matter, said that a Trump appointee named Landon "Tucker" Davis had offered a likelier explanation for why a study that was more than halfway done was abruptly shut down: In Davis' words, "Science was a Democrat thing."
"I was deeply offended," Lowenthal told Salon when asked about Davis's comment. “Without independent science, evidence, facts and expertise, policy is made in the dark and special interests can lie to the public and rewrite the rules for their own benefit."
"If the administration dismisses science as a ‘Democrat thing,’ the results will speak for themselves: worse public health, environmental degradation and more and more misguided policy," he added.

In January, the Union of Concerned Scientists released a report outlining the evident contempt the Trump administration has for actual science. The report found "that the administration has interfered with or sidelined science in 80 separate incidents over the past two years."
Instead of science, which is apparently a "Democrat thing," the Trump administration is guided more by right-wing ideology and, of course, the interests of its rich benefactors.
"Comments like these barely scratch the surface of the rampant disregard for standards that protect our nation's land and water at Donald Trump's Department of Interior," Chris Saeger, director of the Western Values Project, told Salon. "The corruption that has taken hold at Interior has rendered meaningless the distinction between the employees there and the lobbyists that seek to profit from America's natural resources."
